Microsoft Negotiates Continuous Access to OpenAI Technologies After AGI Milestone

Microsoft is in discussions with OpenAI regarding a new agreement that would guarantee ongoing access to the company’s technologies, even after OpenAI reaches what it defines as AGI (Artificial General Intelligence). If finalized, this deal would mark a significant milestone in OpenAI’s path toward commercialization.

According to Bloomberg, citing three anonymous sources, the companies are negotiating and might finalize an agreement within a few weeks. Some insiders also mention that despite positive trends, additional obstacles, such as regulatory scrutiny and Elon Musk’s lawsuit seeking to block OpenAI’s transition to a for-profit model, could arise.

OpenAI is structured as a nonprofit entity focused on achieving a specific mission while also overseeing a capped-profit commercial company. This arrangement is intended to limit its commercialization and fundraising capabilities. Nevertheless, OpenAI has raised billions and operates like a typical tech firm, aiming to overcome these limitations.

Microsoft, the largest investor in OpenAI with an investment of $13.75 billion, has created significant hurdles for OpenAI’s future as a commercial enterprise. The negotiations have dragged on for months.

Microsoft seeks to increase its stake in the restructured company and gain access to OpenAI’s technologies. The current agreement remains in effect until 2030 or until OpenAI declares it has achieved AGI, though the exact meaning of AGI remains undefined.

Based on the innovations of the smaller startup, Microsoft has developed the Azure OpenAI service. These technologies have been integrated into Copilot for Windows, Office, and GitHub. If OpenAI suddenly declares that it has reached AGI and cuts off access, Microsoft could lose a considerable strategic advantage. Reports suggest that OpenAI has informed its investors that it expects to pay Microsoft a smaller share of its revenues as it progresses.

Bloomberg indicates that OpenAI is working to ensure the safe implementation of its technology by Microsoft, particularly as it approaches the development of AGI.

The transition of OpenAI to a commercial organization would also benefit Microsoft. The current system limits investor returns, so a more standard structure would enable Microsoft to acquire an official share and generate substantial profits, while still leveraging OpenAI’s technologies.

Bloomberg reports that the two companies are negotiating Microsoft’s equity stake, which could range from 3% to 30%.
